Terms of Service

1. Who We Are

PIM Showcase is a free platform for comic book collectors to catalog, organize, track, and value their personal collections, build want lists, and stay connected with participating local comic shops in the PIM-PRO network. Trading card features are planned for the future. The Service is operated by PIM-PRO LLC.

2. Eligibility

You must be at least 13 years old to create an account or use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. Your Account

• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
• You agree to provide accurate registration information (name, email address, and collecting interest) and to keep it current.
• Notify us promptly at admin@pim-pro.com if you suspect any unauthorized use of your account.
• You may close your account at any time from your account settings. We may suspend or terminate accounts as described in Section 12.

4. The Service

The Service lets you, among other things:

• Catalog the comics you own, including series, issues, variants, grades, condition, and what you paid.
• Build and manage a want list of issues you are still chasing.
• View estimated market values and pricing information for issues in your collection and want list.
• Connect with participating PIM-PRO shops, optionally share your want list with them, and receive notice when a partner shop has an item you want.
• Receive comics that a participating shop pushes to your collection following a purchase (“collection transfers”), which appear as pending items for you to accept or reject.

We may add, change, or remove features at any time. The Service is provided on an “as is” and “as available” basis (see Sections 13 and 14).

5. Market Values Are Estimates, Not Advice

Pricing and market values shown in the Service are estimates compiled from third-party data sources and active or historical listings. They are provided for informational and personal-reference purposes only. They are not appraisals, offers, guarantees of value, or financial, investment, or tax advice, and they may be inaccurate, incomplete, or out of date. Actual sale prices depend on many factors we do not control. You are solely responsible for any buying, selling, insuring, or other decisions you make, and we encourage you to obtain independent professional valuation before acting.

6. Partner Shops and the PIM-PRO Network

Participating comic shops are independent third parties. When you choose to share your want list with a shop or accept a collection transfer, you authorize us to share the relevant information with that shop to provide the Service. We are not responsible for the acts, omissions, products, pricing, or conduct of any shop, and any transaction you enter into with a shop is solely between you and that shop. Items pushed to your collection by a shop are not verified by us; you are responsible for reviewing and accepting or rejecting them.

7. Your Content

“Your Content” means the collection data, want lists, notes, and other information you add to the Service. As between you and us, you retain ownership of Your Content. You grant PIM-PRO a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and use Your Content solely to operate, provide, secure, and improve the Service and to deliver the features you request (such as sharing a want list with a shop). You are responsible for Your Content and represent that you have the rights necessary to submit it.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful, infringing, or fraudulent purpose.
• Access another user's account or data without authorization, or interfere with the security of the Service.
• Scrape, harvest, or systematically extract data, including catalog or pricing data, except as expressly permitted.
• Upload malware, attempt to disrupt or overload the Service, or probe or test its vulnerability without our written consent.
• Reverse engineer, resell, or commercially exploit the Service or its data except as expressly allowed by these Terms.
• Misrepresent your identity or your affiliation with any person or shop.

9. Intellectual Property

The Service, including its software, design, text, and logos, is owned by PIM-PRO or its licensors and is protected by intellectual-property laws. Comic book titles, cover images, characters, and related marks are the property of their respective publishers and rights holders; they are used within the Service for identification and cataloging purposes and their appearance does not imply any endorsement or affiliation. Except for the limited right to use the Service under these Terms, no rights are granted to you.

10. Privacy

Our collection and use of your information is described in our Privacy Policy and Cookie Notice, which are incorporated into these Terms by reference. By using the Service, you consent to those practices.

11. Fees

The Service is currently offered free of charge. We reserve the right to introduce paid plans or features in the future. If we do, we will give you notice and you will not be charged for any paid feature without your agreement.

12. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including Sections 5, 7, 9, and 13–16) will survive.

13. Disclaimers

THE SERVICE AND ALL CONTENT, INCLUDING PRICING AND MARKET-VALUE ESTIMATES, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA OR VALUATION IS ACCURATE OR COMPLETE.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PIM-PRO AND ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR COLLECTION VALUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless PIM-PRO LLC and its owners, employees, and partners from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and PIM-PRO agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute that is not subject to arbitration or small-claims court, and you consent to personal jurisdiction and venue there. Any dispute must be brought in your individual capacity and not as part of a class action.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
